• Federal Appeals Court Rejects Hunter Biden’s Appeal To Dismiss Gun Charges

    A federal appeals court Thursday dismissed Hunter Biden’s Appeal to have his gun charges dismissed.  Biden’s gun trail is scheduled for early June in Delaware. 

    "This appeal is DISMISSED because the defendant has not shown the District Court’s orders are appealable before final judgment," reads the court's ruling from the Third Circuit Court of Appeals based in Philadelphia, which covers Delaware’s jurisdiction where the alleged gun violations occurred and where the trial will be held.

    Biden had appealed to the higher court after Delaware trial Judge Maryellen Noreika rejected his Motion to Dismiss the case in early April.

    The Trump-appointed judge disagreed with Biden's arguments that Special Counsel David Weiss – who is also prosecuting President Biden's son on separate tax charges in California – violated the original plea deal and diversion agreement the parties negotiated with the Justice Department that would have granted Hunter Biden broad immunities.

    Judge Noreika did not approve Biden's plea agreement in June 2023 after she asked the prosecutor if there was an ongoing investigation. The prosecutor affirmed such to the court and hence, Judge Noreika was prohibited from approving that plea agreement. 

    Weiss subsequently charged Hunter Biden.

    Biden faces three charges in Delaware stemming from his purchase of a firearm in 2018: one count of unlawful possession and two counts of false statements.
