The U.S. House of Representatives’ January 6 Select Committee on Monday made the unprecedented criminal referral of a former president seeking re-election to the Department of Justice with the intention of preventing him from every serving office in the future.
The outgoing Congresswoman Liz Cheney (R-WY) said that Trump was “unfit to serve.”
Donald Trump has announced his 2024 presidential campaign.
The committee unanimously recommended for the Department of Justice to prosecute Trump and others for obstruction of an official proceeding, conspiracy to defraud the United States, conspiracy to make a false statement to the federal government and inciting, and assisting or aiding an insurrection.
January 6 Committee Congresswoman Zoe Lofgren (D-Calif.) at the hearing said the panel found evidence that attorneys connected to the former president offered jobs to witnesses in a possible attempt to coerce them to conceal information.
Fellow committee member Stephanie Murphy (D-Fla.) said the panel found evidence that Trump planned on going to the Capitol building on Jan. 6, although he ultimately did not.
The Department of Justice can reject the referrals.
The agency may not follow the panel's recommendations anyway as it is conducting a separate investigation into the Jan. 6, 2021, riot. That investigation is heading up by Special Prosecutor Jack Smith.
FOX Legal Analyst Jonathan Turley said that so far he does not see “any evidence” from the committee that warrant convictions or survive an appeal.
“I would hope they do not bring charges,” said former vice-president Mike Pence.
“This is just more polarization of the committee’s work,” said Congressman Jim Jordan (R-OH).
Multiple members of Congress also have been referred to the House Ethics Committee.
The January 6 Committee had asked for members to co-operate. None of them agreed. The committee then issued subpoenas. None of them complied.
The Committee’s Final report will be released on Wednesday.
