A new Covid variant means another unnecessary mandate from the Department of Justice and the Biden administration. The latest push for mandates had lawyers for the DOJ presenting an argument for the 11th Circuit Court of Appeals requesting reinstatement of a mask mandate for air travel. The initial travel mask mandate was struck down by a federal judge last April.
The Justice Department wrote in a statement last April when the mandate was struck down that "The Department continues to believe that the order requiring masking in the transportation corridor is a valid exercise of the authority Congress has given CDC to protect the public health. That is an important authority the Department will continue to work to preserve."
When asked last year after a federal judge ruled the travel mask mandate unlawful, President Joe Biden told a reporter, "that's up to them" when asked whether or not people should continue to wear masks on planes.
Despite Biden previously declaring that the Covid-19 "pandemic is over" and stating that wearing masks is a personal choice, Biden's Justice Department is attempting to have the mask mandate reinstated.
The 11th Circuit Court of Appeals heard arguments regarding reinstating a travel mask mandate on behalf of the CDC on Tuesday.
Meanwhile the Health Freedom Defense Fund (HDFD), which is a medical rights advocacy group, has stated that requiring travelers to wear masks "lacks not only any rooting in federal statutes, but it also violated existing federal law in how it was promulgated. The mandate also suffers from an inconsistent application of sound science."
HFDF founder and President Leslie Manookian said in a press statement, "The Biden administration is trying to paper over an illegal, sweeping mandate on Americans that is full of massive legal and scientific holes."
"That a federal agency should be able to just usurp the power of Congress and violate fundamental individual rights is not only at odds with the law - it defies basic common sense."
It is unclear if the Court will hear additional arguments or when a ruling on the mandate can be expected.
