A 2022 President Joe Biden-appointed California judge rejected Robert F. Kennedy Jr.'s request for a restraining order against Google and YouTube in a censorship lawsuit filed earlier this year.
Mr. Robert F. Kennedy, Jr. is running for president as a democrat. He announced his candidacy in Boston in April 2023.
This order follows Mr. Kennedy and his 2024 Democratic presidential campaign security officials’ proffer of nearly 70 pages of documentation to the Biden Administration requesting secret service protection for Mr. Kennedy as a presidential candidate.
The Biden Administration refused to grant secret service protection though there is a plethora of evidence by earlier administrations - both republican and democratic - granting presidential candidates early secret service protection.
In this censorship case though, U.S. District Judge Trina Thompson ruled that Kennedy did not meet the threshold for a preliminary injunction to be granted on the grounds for the First Amendment argument because Google and YouTube are private companies.
But, it gets better demonstrating the callous lack of judicial critical thinking and detail.
In the order, Judge Thompson, who is a graduate of University of California at Berkley and born two years before the 1963 assassination of President John F. Kennedy, wrote a stunningly inaccurate and disturbing order, which demonstrates she is either asleep at the wheel in her courtroom or massively stupid and lacking in U.S. history.
Judge Thompson refers to Robert F. Kennedy as John F. Kennedy, Jr.
John F. Kennedy, Jr. was the son of President John F. Kennedy. John F. Kennedy, Jr. is one of many first cousins related to Robert F. Kennedy, Jr. John F. Kennedy, Jr. died in a plane crash on his way to a family wedding in July 1999. The late President John F. Kennedy and the late Senator Robert F. Kennedy were brothers. Robert F. Kennedy was assassinated in 1968 when he too ran for president.
In this censorship case, Robert F. Kennedy, Jr. had requested a temporary restraining order to restore certain videos removed by Google and YouTube on the grounds they had asserted were based upon COVID-19 medical and vaccine "misinformation."
The videos included a speech Robert F. Kennedy, Jr. gave at Saint Anselm College in New Hampshire, an interview with podcaster Joe Rogan and an interview with clinical psychologist Jordan Peterson. There were all done after his campaign announcement in April 2023.
In his request, Robert F. Kennedy, Jr. sought to prevent Google and YouTube from using the terms and conditions to remove future videos of himself during his 2024 presidential campaign.
Judge Thompson stated that Kennedy "has not shown that he has been irreparably harmed by Google or YouTube because he does not demonstrate urgency or that his speech will be censored on other social media platforms.”
She added that "a temporary restraining order does not serve the public interest of preventing the spread of illness and medical misinformation."
Thompson based her opinion on a Ninth Circuit decision that ruled Twitter, the social media site now called X, exercised its "own independent judgment" in adopting content moderation policies and enforcing them.
The next court date for all parties in this case to appear in person before Judge Thompson is November 7, 2023.
Hopefully, Judge Thompson will figure out who is before her court and correct her own record, and who is running for president since she was appointed by President Joe Biden in 2022 for her current post.
In 2011, President Barack Obama appointed Judge Thompson to serve on the Coordinating Council on Juvenile Justice and Delinquency Prevention.
