A first draft of a U.S. Supreme Court opinion involving abortion rights was published on Monday night in Politico.

On Tuesday, the U.S. Supreme Court Public Information Office acknowledged the leak as “authentic,” and U.S. Supreme Court Chief Justice John Roberts ordered an investigation. 

The leak "does not represent a decision by the Court or the final position of any members on the issues in the case,” reads the Supreme Court’s position. 

Subsequently, the White House released President Joe Biden’s statement, who disagreed with the court’s recognition of the documents authenticity and final disposition.  

“We do not know whether this draft is genuine, or whether it reflects the final decision of the Court,” stated the White House release. 

Once again, the Biden administration communication skills defies accuracy over a most serious matter of judicial breach at the highest court in the U.S. judicial system, but goes further.

President Biden focused on politics in his statement looking to further seemingly to fuel the debate on abortion and to turn this leak into a political football to gin up voters for the 2022 mid-term elections eviscerating the serious breach of confidentiality among Supreme Court justices, and their clerks and staff.  

“With that critical caveat, I want to be clear on three points about the cases before the Supreme Court,” states President Biden.

“First, my administration argued strongly before the Court in defense of Roe v. Wade. We said that Roe is based on “a long line of precedent recognizing ‘the Fourteenth Amendment’s concept of personal liberty’… against government interference with intensely personal decisions.” I believe that a woman’s right to choose is fundamental, Roe has been the law of the land for almost fifty years, and basic fairness and the stability of our law demand that it not be overturned.”

“Second, shortly after the enactment of Texas law SB 8 and other laws restricting women’s reproductive rights, I directed my Gender Policy Council and White House Counsel’s Office to prepare options for an Administration response to the continued attack on abortion and reproductive rights, under a variety of possible outcomes in the cases pending before the Supreme Court. We will be ready when any ruling is issued.”

“Third, if the Court does overturn Roe, it will fall on our nation’s elected officials at all levels of government to protect a woman’s right to choose. And it will fall on voters to elect pro-choice officials this November.  At the federal level, we will need more pro-choice Senators and a pro-choice majority in the House to adopt legislation that codifies Roe, which I will work to pass and sign into law,” concludes President Biden again moving the goal posts of the U.S. Constitutional separation of powers clause. 

It is not unusual for a first draft opinion to be circulated among justices. What is unprecedented is this leak. 

Roberts thinks this leak is so serious he ordered the Marshal of the Court to do an investigation. 

Clearly, President Biden shamelessly is using the Oval Office to turn a sacred breach of such historical magnitude into a political football for the 2022 midterms while he is tanking in the polls. 

The 2022 mid-term elections has now morphed into “the ends justifies the means” campaign.
