Classified documents from Joe Biden's time as Vice President surfaced in early November at Biden's think tank, the Penn Biden Center in Washington, according to CBS News, citing two sources with knowledge of the inquiry Attorney General Merrick Garland has launched.
Biden's special counsel, Richard Sauber, confirmed that Biden's personal attorneys identified the 10 classified documents on November 2, the day before the midterm elections. According to Sauber, the documents were located by Biden's attorneys as they "were packing files housed in a locked closet to prepare to vacate office space at the Penn Biden Center in Washington, D.C."
The documents were located in a folder that was in a box with other unclassified documents.
While it has been confirmed that the documents do not contain nuclear codes, it remains unclear what the documents do contain and what their classification level is.
When it was discovered that former President Donald Trump had classified documents comingled with unclassified documents the DOJ raided Trump's home. However, when the discovery was made of Biden's classified documents mixed in with unclassified documents, the White House counsel's office simply notified the National Archives the same day and had the documents picked up the next morning. It hardly seems an equal reaction.
According to Sauber, "The discovery of these documents was made by the President's attorneys. The documents were not the subject of any previous request or inquiry by the Archives. Since that discovery, the President's personal attorneys have cooperated with the Archives and the Department of Justice in a process to ensure that any Obama-Biden Administration records are appropriately in the possession of the Archives."
U.S. Attorney for the Northern District of Illinois, John Lausch, has been placed in charge of the investigation and will determine how the classified documents ended up at the Penn Biden Center.
It should also be noted that the Penn Biden Center received $54.6 million in Chinese donations after plans for the Center were announced in 2016. It is concerning that classified materials were found stashed in a closet in a building built with Chinese funding and then were turned over to the National Archive in the quietest manner possible on the day of the midterm elections. The Biden Administration, of course, is sure to avoid questions about the documents or find a way to blame Republicans for Biden's negligence and incompetence.
